Terms of Service
Please read these terms carefully before using our services.

1. Acceptance of Terms
By accessing or using XLRE Photography's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services
XLRE Photography provides professional real estate photography, videography, drone photography, 3D virtual tours, floor plans, and related media services. Our services are subject to availability and may vary by location.
3. Booking and Scheduling
When you book a session with us:
- You must provide accurate property information and access details
- The property should be photo-ready at the scheduled time
- Someone with authority to grant access must be present or arrangements made for entry
- Appointments are confirmed via email with date, time, and property address
4. Cancellation and Rescheduling
We understand plans change. Our cancellation policy is as follows:
- 24+ hours notice: Free cancellation or rescheduling
- Less than 24 hours: A cancellation fee may apply
- No-show: Full session fee may be charged
Weather-related cancellations for outdoor/drone photography will be rescheduled at no additional charge.
5. Payment Terms
Payment is due upon completion of services unless otherwise arranged. We accept major credit cards and electronic payments. All prices are in USD and subject to applicable taxes.
For larger projects, we may require a deposit to secure your booking.
6. SMS/Text Messaging Terms
Consent: By providing your phone number when booking a service, creating an account, or calling our business line, you expressly consent to receive SMS/text messages from XLRE Photography. You may also text us to initiate communication, which constitutes consent to receive reply messages.
Types of Messages: We may send you the following types of text messages:
- Appointment confirmations and reminders
- Scheduling changes and updates
- Service delivery notifications (e.g., when your photos are ready)
- Responses to your questions and support requests
Message Frequency: Message frequency varies based on your appointment activity. Expect up to 5 messages per appointment booked.
Costs: Message and data rates may apply. XLRE Photography does not charge for SMS messages, but your mobile carrier's standard messaging rates may apply. Check with your carrier for details about your plan.
Opt-Out: You may opt out of receiving text messages at any time by replying STOP to any message from us. You will receive a single confirmation message after opting out. You can also opt out by emailing hello@xlrephotography.com or calling (925) 575-8513.

Privacy: Your phone number and SMS consent will not be shared with or sold to third parties for marketing purposes. See our Privacy Policy for more information on how we handle your data.
Supported Carriers: Messages are supported on all major U.S. carriers including AT&T, T-Mobile, Verizon, and others. Carriers are not liable for delayed or undelivered messages.
7. Delivery and Turnaround
Standard delivery times are:
- Photography: 24-48 hours
- Video Tours: 3-5 business days
- 3D Virtual Tours: 2-3 business days
- Floor Plans: 2-3 business days
Rush delivery is available for an additional fee. Delivery times may vary during peak seasons.
8. Image Rights and Usage
Upon full payment, you receive a non-exclusive license to use the images and media for:
- Marketing the specific property photographed
- MLS listings and real estate websites
- Social media and print marketing materials
- Personal portfolio use
XLRE Photography retains copyright and may use images for portfolio, marketing, and promotional purposes unless otherwise agreed in writing.
9. Revisions and Edits
All images are professionally edited. Minor revisions are included at no extra charge if requested within 7 days of delivery. Additional editing beyond our standard processing may incur extra fees.
10. Liability and Insurance
XLRE Photography carries professional liability insurance. However, we are not liable for:
- Pre-existing property conditions visible in photos
- Circumstances beyond our reasonable control
- Loss of business or consequential damages
- Third-party claims arising from your use of our media
Our total liability shall not exceed the amount paid for the specific service in question.
11. Property Access and Safety
You represent that you have authorization to grant us access to the property. You are responsible for securing any pets and notifying us of any hazards or restricted areas. Our team follows all safety protocols and FAA regulations for drone operations.
12. Dispute Resolution
Any disputes arising from these terms or our services will first be addressed through good-faith negotiation. If unresolved, disputes will be settled through binding arbitration in accordance with California law.
13. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the new terms.
